Just days before his much-anticipated inauguration on January 20, 2025, Donald Trump faces an unexpected hurdle: sentencing in his hush-money payment to porn star Stormy Daniels.
President-elect Trump is required to appear, either in person or virtually, before Justice Juan Merchan on January 10, 2025, just ten days ahead of being sworn in as the 47th President of the United States at the US Capitol in Washington, D.C.
Trump, who recently defeated Democrat candidate Kamala Harris, 49th vice president of the United States, to secure his second term, had sought to have the case dismissed on the grounds of his November 4th presidential victory. However, New York State Supreme Court Justice Merchan denied his appeal, confirming the sentencing date.
Judge Rules Out Jail Time
Despite the high stakes, Justice Merchan has clarified that a jail term is off the table, signaling an “unconditional discharge.”
In his ruling, the judge stated, “While this Court as a matter of law must not make any determination on sentencing before giving the parties and Defendants an opportunity to be heard, it seems proper at this juncture to make known the Court’s inclination to not impose any sentence of incarceration.”
This statement aligns with the prosecution’s concession that incarceration is no longer a practicable recommendation.
Trump Fires Back
Unsurprisingly, Trump reacted strongly to the ruling, labeling the case a “political attack” and calling it a “rigged charade” designed to undermine him. True to his style, he didn’t hold back against the judge, referring to Merchan as a “radical partisan” and accusing him of issuing an unlawful and unconstitutional order.
“Acting Justice Merchan, who is a radical partisan, just issued another order that is knowingly unlawful, goes against our Constitution, and, if allowed to stand, would be the end of the Presidency as we know it,” Trump said in his post on Truth Social.
He also slammed the restrictions imposed by the case, framing them as an attack on his First Amendment rights. “I am the only political opponent in American history not allowed to defend myself—a despicable First Amendment violation!” he added.
The Charges
In May, Trump was convicted on 34 felony counts of falsifying business records related to a $130,000 (£105,000) payment to adult film star Stormy Daniels. The payment, made during the final days of the 2016 election, was allegedly intended to silence Daniels about an alleged affair with Trump.
His former lawyer, Michael Cohen had facilitated the payment and was later reimbursed. The charges are centered around accusations that Mr Trump attempted to disguise these transactions.
Donald Trump, who is also widely recognized for his business acumen, has pleaded not guilty to all charges, maintaining that he has done nothing wrong. His legal team argued that this case is a politically motivated effort to harm his 2024 presidential campaign.

As the sentencing date approaches, the confluence of Trump’s legal troubles and his return to the presidency positions the nation in unknown territory.
